Oral arguments by New York labor lawyer Abdul K. Hassan, Esq. before the New York Appellate Division, First Department. The Appellate Division (Justices Hon. Cynthia S. Kern, Hon. Peter Tom, Hon. Judith J. Gische, Hon. Barbara R. Kapnick, Hon. Peter H. Moulton) unanimously ruled in favor of Mr. Hassan's client, and upheld the lower court ‘s ruling – that manual workers like Ms. Vega who were paid later than weekly in violation of NYLL 191(1)(a)(i) have the right to bring a lawsuit under NYLL 198 to recover liquidated damages, interest, etc. even though they were paid their wages but paid late such as biweekly, instead of weekly as required by NYLL 191(1)(a)(i) for manual workers. The Court of Appeals (Judges Peter Hall, Amalya Kearse and Denny Chin) unanimously ruled in favor of Mr. Hassan's client, and vacated the jury verdict of the lower court on plaintiff's employment termination claim under the FMLA. The Court of Appeals (Judges Rosemary Pooler, Raymond Lohier, and Susan Carney) unanimously ruled in favor of Mr. Hassan's client, and vacated the summary judgment of the lower court. The Court (Judges Dennis Jacobs, Guido Calabresi, and Reena Raggi), unanimously ruled in favor of Mr. Hassan's client, and upheld the summary judgment awarding her overtime pay etc. - agreeing that the NYC HHC was a joint-employer of Ms. Barfield along with several employment agencies, and responsible for paying her overtime wages.
